Mariastein Abbey, which also operates this website, takes the protection of your personal data seriously. We handle your personal data confidentially and in accordance with legal requirements and the provisions of this data protection declaration.

3. Further information

3.1. Datenbanken

We use the services of hosting providers to deliver our services. We work exclusively with hosting providers that guarantee the databases storing your personal data are protected against unauthorized access, loss, misuse, and falsification. However, we do not have direct control over the actual protection measures implemented by these hosting providers. Therefore, while we take responsibility for carefully selecting them, we cannot guarantee their full compliance with their data protection commitments.

3.2. Sicherheit der Kommunikation im Internet

We would like to point out that data transmission on the Internet (in particular communication by e-mail) is subject to security vulnerabilities. Complete protection of data against access by third parties is – given the technical basis of the Internet – not possible.

3.3. Transport Layer Security (TLS)-Verschlüsselung

Our website uses TLS encryption (formerly SSL encryption) for security purposes and to protect the transmission of confidential content, such as the requests you send to us. You can recognize an encrypted connection by the change in the browser’s address line from ‘http://’ to ‘https://’ and the appearance of a lock symbol in your browser bar. 4. Voluntary nature of the data transfer

You visit our website voluntarily. All data, including your personal data such as your name, address or e-mail address, which you transmit to us in the process, are therefore also provided to us voluntarily, which is why we may use them for the purposes stated in this data protection declaration. However, your personal data will not be passed on to third parties without your prior consent. During your visits, data such as pages accessed or the name of the file accessed, date and time are also collected and stored for statistical purposes by means of cookies. This data is collected without direct reference to your person, which is why it is not considered personal data and can be used freely by us.

According to Art. 6 para. 1 GDPR in particular, our powers to process your personal data are based on the following principles:

  • The fulfilment of a contract with the data subject, as well as the implementation of corresponding pre-contractual measures. (b)
  • The fulfillment of a legal obligation to which we are subject under applicable EU law or under the applicable law of a country in which the GDPR is fully or partially applicable. (lit. c)
  • The protection of vital interests of the data subject or of another natural person. (lit. d)
  • The protection of our own legitimate interests or those of third parties, except where such interests are overridden by the data subject’s constitutional rights or legitimate interests. (lit f)
  • Our legitimate interests include, among other things, our commercial interest in being able to provide our website, information security, the enforcement of our own legal claims and compliance with Swiss law.
  • We process your personal data for the duration necessary for the respective purpose or purposes. In the case of longer-term storage obligations due to legal and other requirements to which we are subject, we limit the processing to these purposes.

We are an online marketing agency, and in order to provide and deliver our services, we may need to request a significant amount of data from you. We emphasize the necessity of providing this information. We process your data in accordance with the Swiss Data Protection Act (DSG) and, where applicable, the EU’s General Data Protection Regulation (GDPR), as part of our services and contractually agreed obligations. Disclosure of your data to third parties will only occur if it is necessary for fulfilling your order.

In particular, we process the following when submitting our offers and providing our services

  • Inventory data (e.g., customer master data, such as names or addresses),
  • Contact details (e.g. e-mail, telephone numbers),
  • Content data (e.g. text entries and images),
  • Contract data (e.g. subject matter of the contract, term),
  • Payment data (e.g. bank details, payment history),
  • Usage and metadata (e.g. to evaluate and measure the success of marketing measures).

The individuals and entities affected by our data processing include our clients, individuals and organizations interested in our services, as well as their customers, users, website visitors, and employees. We delete the data once legal or agreed warranty obligations have expired. The necessity of retaining data is reviewed at irregular intervals. For data provided to us by a client as part of an order, we delete it according to the specifications of the order, typically after the order is completed. In cases where legal archiving obligations apply, data is deleted after these obligations have expired. The legal basis for processing your data is also outlined in Section 5.2.

5.4. Kostenpflichtige Leistungen

In order to provide chargeable services, we request additional data, such as payment details, in order to fulfil your order or request. We store this data in our systems until the statutory retention periods have expired.

5.5. Verwendung von Kontaktformularen

If you send us inquiries via a contact form offered by us or by third parties, your data from the form, including the contact details you provide there, will be stored and processed by us for the purpose of processing the inquiry and in the event of follow-up questions. We do not pass on personal data without your consent.

5.6. Verwendung der Kommentarfunktion unserer Website

When you use the comment function on this website, in addition to your comment, information about when the comment was created, your email address and, if you do not post anonymously, the username you have chosen will be stored.

5.7. Speicherung der IP Adresse

Our comment function stores the IP addresses of users who post comments. As we do not check comments on our site before they are activated, we need this data in order to be able to take action against the authors in the event of legal violations such as insults or propaganda.

5.8. Abonnieren von Kommentaren

As a user of the site, you can subscribe to comments after registering. You will receive a confirmation email to verify that you are the owner of the provided email address. You can unsubscribe from this feature at any time by clicking the link included in the information emails.

6. Special data protection declaration

6.1. Server-Log-Files

The provider of our website automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are

  • Browser type and browser version
  • Operating system used
  • Referrer URL
  • Host name of the accessing computer
  • Time of the server request

This data is not linked to specific individuals and is not combined with other data sources. However, we reserve the right to review this data retrospectively if we become aware of specific indications of illegal use.

6.2. Auf der Website verwendete Dienste Dritter

Our website uses Google Maps for embedding maps, Google Invisible reCAPTCHA for protection against bots and spam, and YouTube for embedding videos. These services are provided by the American company Google LLC and use cookies, among other technologies. As a result, data is transferred to Google in the USA. Google is committed to maintaining an adequate level of data protection in accordance with the US-European and US-Swiss Privacy Shield. Therefore, we assume that no personal tracking occurs through the use of our website alone. However, we cannot provide any guarantee in this regard. Please refer to sections 6.4 – 6.9 below for more details on the Google services we use. Further information can be found in Google’s privacy policy.

6.3. Datenschutzerklärung für Newsletter- und Informationsdaten

If you would like to receive the newsletter offered on our website or other automatically sent information, we require an e-mail address from you as well as information that allows us to verify that you are the owner of the e-mail address provided and that you agree to receive the newsletter and other information. No other data is collected.
We use this data exclusively for sending the newsletter and the requested information and do not pass it on to third parties. You can revoke your consent to the storage of the data, the e-mail address and its use for sending the newsletter and further information at any time, for example via the link to unsubscribe from your address in the newsletter.

6.4. Verwendung von Google Maps

Our website uses the Google Maps service. This allows us to show you interactive maps directly on the website and enables you to use the map function conveniently. When you visit our website, Google receives the information that you have accessed the corresponding subpage of our website. 7. Your rights as data subjects

7.1. Recht auf Bestätigung

7.2. Recht auf Auskunft

  • the categories of personal data that are processed
  • the recipients to whom the personal data have been or will be disclosed
  • where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period
  • the existence of a right to rectification or erasure of personal data concerning them or to restriction of processing by the controller or a right to object to such processing
  • the existence of a right to lodge a complaint with a supervisory authority
  • if the personal data is not collected from the data subject: All available information about the origin of this data

Furthermore, the data subject has a right to information as to whether personal data has been transferred to a third country or to an international organization. If this is the case, the data subject also has the right to obtain information about the appropriate safeguards in connection with the transfer. 7.3. Recht auf Berichtigung

Furthermore, the data subject has the right, taking into account the purposes of the processing, to request the completion of incomplete personal data, including by means of a supplementary declaration.

7.4. Recht auf Löschung

Any person affected by the processing of personal data has the right to demand from our data controllers that the personal data concerning them be deleted immediately, provided that one of the following reasons applies and insofar as the data processing is not necessary for specific reasons:

  • The personal data were processed for purposes for which they are no longer necessary.
  • The data subject withdraws the consent on which the processing was based and there is no other legal basis for the processing.
  • The data subject objects to the processing on grounds relating to his or her particular situation and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing in the case of direct marketing and associated profiling.
  • The personal data was processed unlawfully
  • The deletion of personal data is necessary to fulfill a legal obligation, including the protection of minors, under a law to which we are subject as the operator of the website.

7.5. Recht auf Einschränkung der Bearbeitung

  • The accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data
  • The processing is unlawful and the data subject opposes the erasure of the personal data and requests the restriction of their use instead
  • The controller no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defense of legal claims
  • The data subject has objected to the processing on grounds relating to his or her particular situation and it is not yet clear whether the legitimate grounds of the controller override those of the data subject

7.6. Recht auf Datenübertragbarkeit

Any person affected by the processing of personal data has the right to receive the personal data concerning them in a structured, commonly used and machine-readable format. They also have the right to have this data transmitted to another controller if the legal requirements are met. Furthermore, the data subject has the right to have the personal data transmitted directly from one controller to another, where technically feasible and provided that this does not adversely affect the rights and freedoms of others. To assert the right to data portability, you can contact the data protection officer appointed by the operator of this website at any time. See no. 2 above.

7.7. Recht auf Widerspruch

Any person affected by the processing of personal data has the right to object at any time, for reasons arising from their particular situation, to the processing of personal data concerning them. We will no longer process your personal data in the event of an objection, unless we can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or for the establishment, exercise or defence of legal claims. 7.8 Right to withdraw consent under data protection law

Any person affected by the processing of personal data has the right to revoke consent to the processing of personal data at any time. If you wish to assert your right to revoke consent, you can contact our data protection officer at any time.

7.9. Widerspruch gegen Werbe-Mails

We hereby expressly object to the use of our contact data published as part of our obligation to provide a legal notice for the purpose of sending unsolicited advertising and information material. We reserve the right to take legal action in the event of the unsolicited sending of advertising information, such as spam e-mails, which affect our interests in any way.

8.1. Änderungen

We may amend this privacy policy at any time without notice. The current version published on our website applies. If the privacy policy is part of an agreement with you, we will notify you of the change by email or other appropriate means in the event of an update.
